These Terms of Service ("Terms") govern your access to and use of the website, services, and applications provided by Kreato ("we," "our," or "us"). By creating an account or using the Platform, you agree to be bound by these Terms. 1. ELIGIBILITY AND ACCOUNTS To use Kreato.cloud, you must be at least 18 years old (or the age of majority in your jurisdiction). You agree to provide accurate, complete registration details and maintain the security of your account credentials. You are entirely responsible for all activity that occurs under your account. 2. THE KREATO POINTS SYSTEM * Credits and Allocation: The Platform operates using a proprietary point/credit system. Points are deducted based on the complexity, computational weight, and format of the AI asset generated (Images, Audio, or Video). * No Cash Value: Points hold no monetary cash value, are non-transferable, and cannot be redeemed for legal currency. * Expiration & Changes: We reserve the right to change point-deduction costs per asset type or implement expiration dates on promotional or purchased points at our sole discretion with prior platform notice. * Refunds: All purchases of points are final and non-refundable unless required by local consumer laws in your jurisdiction. 3. INPUTS, OUTPUTS, AND INTELLECTUAL PROPERTY * Your Inputs: You retain all ownership rights to the prompts, text, images, or audio clips you upload or input into the platform ("Inputs"). You warrant that your Inputs do not infringe on any third-party intellectual property or privacy rights. * AI-Generated Outputs: Subject to your compliance with these Terms, Kreato.cloud hereby assigns to you all its rights, title, and interest in and to the specific digital media files generated by the platform based on your Inputs ("Outputs"). You are free to use these Outputs for commercial and non-commercial purposes. * Platform License: By using the platform, you grant Kreato.cloud a limited, worldwide, royalty-free license to host, process, and transmit your Inputs and Outputs solely to provide and improve our services, optimize AI performance, and prevent system abuse. * Nature of AI: You acknowledge that due to the nature of machine learning, Outputs may not be completely unique across different users, and identical prompts may yield identical or similar outputs to other platform users. Kreato.cloud claims no responsibility for overlapping output results. 4. ACCEPTABLE USE AND PROHIBITED CONTENT You agree not to use the Platform to generate, share, or upload content that: * Is illegal, defamatory, harassing, sexually explicit, or incites violence. * Infringes upon the copyright, trademark, or rights of privacy of any individual or entity. * Intentionally creates deceptive, fraudulent, or malicious deepfakes or misinformation. * Leverages automated scrapers, bots, or script injections to harvest data, reverse-engineer platform models, or manipulate the points system. 5. TERMINATION We reserve the right to suspend or terminate your account and forfeit any remaining point balance instantly without prior notice if you breach these Terms, violate international laws, or engage in activity that threatens the technical stability or integrity of Kreato.cloud. 6. LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES THE PLATFORM AND ALL OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KREATO.CLOUD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA LOSS, OR SYSTEM DOWNTIME RESULTING FROM GENERATION FAILS. 7.
